Privacy Policy
This is the privacy policy of the Business Council of Australia ABN 75 008 483 216 of Level 42, North Tower, 80 Collins Street Melbourne, Victoria. All references to “we”, “us”, “our” or “the BCA” are references to the Business Council of Australia.
Privacy Act and the purpose of this policy
We adhere to the Privacy Act 1998 (Cth) (“Privacy Act”) and the Australian Privacy Principles therein. This Privacy Policy outlines how we collect, access, store and use personal information, which we obtain through our business operations. By providing us with personal information and/or using the BCA website, or any other website owned and operated by us (“Site” or collectively “Sites”), you agree to the terms of this Privacy Policy as updated. This Privacy Policy is to be read in conjunction with the Terms of Use for the relevant Site.

Personal information we collect and how we collect and store personal information
We collect personal information in a number of ways, including:
- directly from you, for example, when you:
- subscribe to receive email updates or other news, services or updates from any of our Sites;
- subscribe to receive updates by opting in via mobile phone text message at a function or event held or sponsored by us;
- complete an online survey carried out by us or on our behalf; or
- fill in a form on any of our Sites; and
- as part of the membership process, as we collect personal information relating to our members.
Personal information we collect includes, but is not limited to, contact details, such as your full name, email address, phone number and postcode, as well as company/employment details. We may also collect information about your interactions with us, for example, when you attend meetings we organise or events we host, facilitate or arrange.
When you access any of our Sites, our server also collects technical or navigational information about your use of our services (“Usage Information”). Usage Information cannot be used by a third party to personally identify a user of our Sites, as the information collected is anonymised, including but not limited to browser type, IP address, the URL you accessed, pages views and time spent on our Site(s), cookies, domain type and service provider. This information is used for internal statistical purposes and to improve our Sites. No attempt will be made to identify individual users or their browsing activities except in the unlikely event of an investigation, where a law enforcement agency may exercise a warrant to inspect the Internet web server logs.
We collect, store and use this personal to:
- provide you with products and services, and manage our relationship with you;
- facilitate your attendance at events;
- contact you, for example, to respond to your queries or complaints, or if we need to tell you something important; and
- comply with our legal obligations and assist government and law enforcement agencies or regulators
We comply with all laws relating to spam and unsolicited mail, and you will always have the option to unsubscribe from marketing communications by following the opt-out instructions provided in the communication.
If you do not give us this information on request, we may be unable to supply the information or update that you requested, or provide our services to you.
Security of personal information
We store personal information in computer systems and databases operated by either us or our external service providers. We take various measures, depending on the type of information, to ensure the safety of the information we store. We take reasonable steps to protect personal information against loss, interference, misuse, unauthorised access, modification and disclosure. When personal information is no longer required, we will take reasonable steps to destroy the information or de-identify the information.
Disclosure of personal information
We may transfer or disclose your personal information to our related companies.
We may provide some of your personal information to a third party to assist with the provision of services for us or on our behalf. For example, a customer’s contact details and address may be provided to a service provider responsible for sending out emails, providing IT or other services on our behalf. We may also provide your name and contact information to third parties who are hosting, arranging or facilitating events you have indicated that you would like to attend.

- we are required or authorised by law to do so;
- you have expressly consented, or the consent may be reasonably inferred from the circumstances; or

We also use third-party service providers who may store or process your personal information outside of Australia, including the United States of America.
We do not provide your personal information to mailing list companies.
Access to your personal information and resolving complaints
You may access or request correction of the personal information that we hold about you by contacting us. Our contact details are set out below. There are circumstances in which we are not required to provide you with access to your personal information.
There is no charge for requesting access to your personal information, but we may require you to meet our reasonable costs in providing you with access (such as photocopying costs or costs for time spent collating large amounts of material).

Our Sites are operated by the Business Council of Australia ABN 75 008 483 216 of Level 42, North Tower, 80 Collins Street, Melbourne, Victoria (“BCA” “we” “us” “our”) using commercial web hosting facilities.
These terms govern your use of our Sites. By using our Sites, you confirm that you accept these terms of use and that you agree to comply with them. If you do not agree to these terms, you must not use our Sites.
We may update and change our Sites from time to time to reflect changes to our users’ needs, changes in law and our business priorities, or for any other reason.
When you visit our Sites
When visiting our Sites, you do not have to disclose your identity to us. However, our Sites may use “cookies” to collect anonymous traffic data from users who access our Sites. You release us, our directors, officers, employees and agents from any claims and damages arising out of or in connection with any claim you have against any such third parties.
Limitation of liability
The Internet is not a secure medium and communications to and from our Sites may be intercepted or altered in transit. We do not warrant that our Sites are free from anything which may damage any computer which accesses our Sites or data on such computer.
This Site is provided on an “as is” basis. While we have used our best endeavours to ensure that the information contained on and accessed through the Site is correct and current at the time of publication, we do not accept responsibility for any error, omission or defect in the information. To the fullest extent permissible by law, the BCA, our related companies and our respective directors, employees, agents and contractors:

Nothing in this clause affects any liability which cannot be excluded or limited under applicable law. We do not exclude or limit in any way our liability to you where it would be unlawful to do so. Where our liability cannot be excluded, we limit our liability to the fullest extent permitted by the Australian Consumer Law.
Except for any liability that cannot by law be excluded, and to the full extent permitted by law, under no circumstances (including but not limited to any act or omission on our part, by our related companies or their respective directors, employees, agents and contractors) and howsoever caused including by negligence, will the BCA, our related companies or their respective directors, employees, agents or contractors accept liability for any loss or damage whatsoever resulting from any use or access, or any inability to use or access the Sites.
Intellectual Property
Unless otherwise indicated, we reserve all copyright and all other intellectual property rights in the content and design of our Sites. We own all such intellectual property rights or uses it under licence or applicable law. You may make a temporary copy of part or all of our Sites on your local computer for the sole purpose of viewing it, and print a single hard copy of a whole page of a Site for personal use, provided that any copyright notice on such page is not removed. You may not, in any form, or by any means:

We own the trademark for the Business Council of Australia logo and reserves all rights in relation to this trademark. We may make changes to these terms of use from time to time and if so, will publish updated terms of use on our Sites. By using the Site, you are agreeing to be bound by these terms as updated.
Community Guidelines
We are committed to keeping our online communities and conversations respectful. To maintain a safe and constructive online community, we have established guidelines that govern all expected behaviours across our social media and online communities. We ask that all users follow these guidelines.

We do not tolerate comments that are:
- Abusive, threatening, harassing, or attacking others
- Hateful or discriminatory
- Offensive or profane
- Spam-like
- Otherwise inconsistent with our values.

We will respond to messages and comments at our discretion.

- Please post using your own name and social accounts. Comments from anonymous, offensive, or suspicious profile names will be deleted
- Do not reveal any personal or sensitive information about yourself or others.
- Do not break the law or encourage others to do so, for example, by posting content that amounts to defamation, contempt of court or breach of copyright.

Australian law applies to disputes
These terms of use, their subject matter and their formation are governed by Australian law. You and we both agree that the courts in Australia will have exclusive jurisdiction.
