Submission to Treasury on the review of unfair contract terms

This is the Business Council of Australia’s submission to Treasury’s November 2018 Discussion Paper, Review of Unfair Contract Terms for Small Business.
The Business Council's submission makes proposals that would provide parties with greater certainty as to which of their standard form contracts is subject to the unfair contract laws.
It also reiterates the need for clear guidance about how the law will be interpreted and applied and cautions against punitive enforcement measures.
