Submission on options to strengthen the misuse of market power law

This submission maintains the Business Council’s view that section 46 of the Competition and Consumer Act 2010 works as intended and should not be amended.

The review process has not identified any evidence of an economy-wide problem that justifies change, and the alternative options put forward by Treasury would introduce major regulatory uncertainty and risk. This would be harmful to consumers and economic growth. 

Furthermore, the government has already put in place a number of new policies to address anti-competitive and unfair business conduct and these should be given time to work.
