Submission to the Department of Treasury on the Exposure Draft Legislation for Extending Unfair Contract Term Protections to Small Businesses

The Business Council continues to regard extending consumer unfair standard contract term protections to small businesses as unwarranted.

We set out in this submission, and our earlier submission to Treasury,  our concerns about the additional regulatory burden on business, which arise from:

•    new compliance costs
•    regulatory uncertainty
•    the increased risk of litigation.

This submission proposes changes to reduce the risk of unintended impacts from the exposure draft, and notes the BCA's concerns with the adequacy of the assessment in the decision Regulation Impact Statement.
